Purchaser shall mean Client, Client shall mean Purchaser.* IN RESPECT TO PRIZE DRAWS AND SPECIAL OFFERS:
This competition is open to anyone resident in the UK or Eire, except employees and their families of kidsmusiccds.co.uk and anyone else connected with the competition. No responsibility can be accepted for entries that we did not receive. A winning entry is the first name drawn from the email entries after the closing date. The winner will be notified by email or post and the results published on the kidsmusiccds.co.uk web site. The winner must agree to the publication of their name. The decision of the director is final. No correspondence can be entered into. Entry implies acceptance of these rules.

PLACING A PROVISIONAL ORDER
Provisional placement for supply of services/products shall mean there is intent on both parties to move forward in purchase and supply of services/products. Any preparatory work undertaken by kidsmusiccds.co.uk up until the point of kidsmusiccds.co.uk receiving confirmation decline by the Purchaser will remain as chargeable to the Purchasers account.
CONFIRMATION - Confirmation is determined by receipt of payment, in part or full, by kidsmusiccds.co.uk in full unless agreed otherwise.
CURRENCY - UK Pounds Sterling. All other currencies at BOE official exchange rate plus 3% charges as at time date of payment.
PAYMENT - Complete Payment &/or Deposit Payment of supply of services/products Fees:
Payment may be made by Cheque, Credit Card (which will attract a transaction fee at current kidsmusiccds.co.uk published rates), BACS or UK Bank Standing Order (BSO).
Outstanding Balance of supply of services/products Fees:
Payment maybe made, with mutual agreement, by UK Bank Standing Order (BSO) or, by arrangement UK Direct Debit, for the period stipulated at the time of confirmation of Outstanding Balance normally on the 1st UK bank trading day, or closest thereafter, of each month.
In cases of non-receipt of Balance &/or supply of services/products commissioned services/product delivery will be suspended until resolved as stated in "liability/rights" followingEXPENSES - Supply of services/products requiring attendance – by a/more than one kidsmusiccds.co.uk representative - at a venues selected by the Client other than kidsmusiccds.co.uk facilities may attract additional expenses, which will be chargeable to the Client's account.
STANDARD COMMISSION - Unless specifically agreed otherwise the standard commission for supply of services/products details will be detailed in the Confirmation of Order whichever is as agreed between Client and kidsmusiccds.co.uk.
CANCELLATION BY CLIENT - No refunds are given. Any fees outstanding will be invoiced as settlement of the account.
COMMISSION CANCELLATION BY kidsmusiccds.co.uk - Where a supply of services/products is cancelled for any reason with or without prior notice being given to the Client, kidsmusiccds.co.uk will endeavour to offer mutually agreeable reimbursement – pro rata to work / time period expended / expired in the execution of the supply of services/products. This offer will not apply where kidsmusiccds.co.uk is under commitment to cancel supply of services/products when advised of previously undeclared existing/pending legal action by others.
LIABILITY/RIGHTS - kidsmusiccds.co.uk shall not be held liable for any loss, financial or otherwise, incurred in excess of the fees paid; reserves the right to alter any part of the content, retains the right to include reference, by whatever means, to kidsmusiccds.co.uk part or in total involvement of the commission and use as reference the supply of services/products, in whole or part, the supply of services/products as an example of supply of services/products undertaken; kidsmusiccds.co.uk sometimes acts as facilitator to other Companies who are the end service suppliers and as such acts in good faith between Client and Service Supplier and will not be held responsible for any loss whatsoever should the Client and Supplier become in dispute for any reason; kidsmusiccds.co.uk will not be liable for or enter disputes in respect to data/supply of services/products use, legal or financial claims on Clients by others in respect to content or copyright material presented by the Client for use in the commission; kidsmusiccds.co.uk retains the right to amend these terms and conditions and will publish such details on its web site which in turn will be deemed to supersede any previous publication.
